TAKE NOTICE that the Council of The Corporation of the Town of Carleton Place passed By-law No. 53-2022 on the 11th day of October, 2022, to adopt the Community Improvement Plan (CIP), in accordance with Sections 17 and 28 of the Planning Act, R.S.O. 1990, c. P. 13, as amended.
THE PURPOSE AND EFFECT of the CIP is to identify priorities and design financial incentives for three separate objectives: (i) create more affordable housing, (ii) revitalize the downtown, and (iii) encourage the redevelopment of underutilized but potentially contaminated properties commonly referred to as ‘brownfields’.
All oral and written submissions received regarding the CIP were considered as part of the Town’s review process. Pursuant to Section 17(23.1) of the Planning Act, a Statutory Public Meeting was held on August 23rd, 2022, to present the draft CIP for public comment, during which two delegates asked questions and/or provided comments on the CIP. A meeting of the Committee of the Whole was also held on September 13th, 2022, where additional feedback received from some Town Councillors prompted certain revisions to the CIP’s Brownfield Redevelopment incentive programs. Their feedback was addressed in the final version of the CIP that was adopted on October 11th, 2022.
The CIP is exempt from approval by the Minister of Municipal Affairs and Housing. The decision of Council is final, if a notice of appeal is not received on or before the last day for filing a notice of appeal.
AND TAKE NOTICE that any person or agency may appeal to the Ontario Land Tribunal (OLT) in respect of the By-law by filing with the Town Clerk, no later than 4:00 p.m. on the 9th day of November, 2022. The Notice of Appeal must: set out the specific part(s) of the Community Improvement Plan to which the notice of appeal applies; set out the reasons for the appeal; and be accompanied by the fee charged by the Tribunal and made payable to the Ministry of Finance. Appellants must use “Appellant Form (A1)”, which is available through the OLT website (at https://olt.gov.on.ca/appeals-process/forms/) or the Town Clerk.
Only individuals, corporations and public bodies may appeal the by-law to the OLT. An unincorporated association or group may not file a Notice of Appeal, however a Notice of Appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
