Terms and Conditions of Sale:

  1. The Buyer acknowledges and accepts the encroachments of the frame shed, carport and edge of asphalt driveway into Part 13 as shown on Plan 27R-12376;
  2. The Town shall reserve an easement over Part 18 on Plan 27R-12376 in favour of itself for an unground drainage pipe;
  3. The Buyer acknowledges that the property is being sold “as is” and there are no warranties or representations with respect to the physical condition of the property, including any environmental matters.

Notes:

Interested purchasers are advised that an existing storm drainage pipe is located on the property and currently provides a drainage outlet for the rear yards along MacArthur Ave and Napoleon St. If future development/building on the property requires the removal of this pipe, the builder or developer will be responsible for establishing a new outlet to ensure the existing drainage pattern is not negatively affected. If the proponent intends to install a new catch basin and lead, a drainage easement with a minimum width of 3.0 m must be dedicated to the municipality.
